Lehigh University student who sued over C+ grade won't get a new trial, judge rules

A Lehigh University graduate who sued over her C+ grade won't get a new trial, a Northampton County judge ruled Monday.

Megan Thode was hoping that Judge Emil Giordano would reconsider his verdict in February, when he found that the Bethlehem school had neither breached contract nor discriminated against her when it awarded her the grade in 2009 in a master's degree fieldwork class.

But in a brief order, Giordano rejected her post-trial motions, reiterating his conclusion that Thode failed to show the university acted "arbitrarily and capriciously" in giving her the mark.
